Foundation of Estate Planning: Your Will

A last will and testament is an important document in any well-designed estate plan. Your will can put the right people in place (an executor to administer your estate, a guardian to care for your children), divide assets and/or pass assets to trusts.

When should you see a lawyer about drawing up a will?

If you have dependents and/or assets you would like to leave to your family, you should have an up-to-date will. In our experience, there are often specific situations that trigger calls to our law office about a will. These include:

  • Parents interested in appointing a guardian for children in the event the parents pass away. Parents often also want to ensure that other assets are appropriately managed for the children's benefit.
  • We often get calls to modify preexisting wills after the children reach majority and the family's circumstances have changed. A new will can reflect the family's changed needs and concerns.
  • Periods of travel, a job change or diagnosis of a chronic illness can precipitate the need for a will and for other estate planning tools such as durable powers of attorney.

Review your will every 3-5 years — or when changes occur in your family.

It is a good idea to review your will periodically to determine if it still meets your needs. Births, adoptions, marriages, deaths and lengthy illness can trigger the need for a new will. As your lawyer, Stuart Hamilton will notify you if legal changes will affect your will.
